Legal Services of New Jersey Report and Recommendations to the New Jersey Supreme Court concerning False Statements and Swearing in Foreclosure Proceedings, November 4th, 2010

On Monday December 20, 2010, New Jersey Chief Justice Stuart Rabner announced the entry of three orders issued to protect the integrity of the fiilings of foreclosures in New Jersey. Judge Grant issued an Administrative Order requiring 24 lenders and servicers to file certifications demonstrating that there exists no irregularities in their handling of foreclosure proceedings. In the Order, Judge Grant cites “a detailed report prepared by Legal Services of New Jersey dated November 4, 2010, with supporting materials, alleging industry-wide deficiencies in foreclosure proceedings” as contributing to the entry of the Order. The report referenced by Judge Grant has three parts: (1) a description of the problematic certification and evidentiary practices, (2) the national and New Jersey evidence of the prevalence of false certification practices and (3) recommendations for Supreme Court action. The supporting materials include some twenty five exhibits including deposition transcripts of so called robosigners, examples of false certifications and false swearing in particular cases in New Jersey, scholarly articles, judicial decisions and media reports.
